<p>The two-time Grammy winner, whose second album &#8220;21&#8243; smashed chart records around the world last year, was forced to cancel her U.S. tour dates in late 2011 when she underwent vocal cord microsurgery in Boston in November.</p>
<p>&#8220;I&#8217;m immensely proud to have been asked to perform at this year&#8217;s Grammy Awards,&#8221; the 23-year-old &#8220;Rolling in the Deep&#8221; singer said in a statement.</p>
<p>&#8220;It&#8217;s an absolute honor to be included in such a night and for it to be my first performance in months is very exciting and of course nerve-racking, but what a way to get back into it all.&#8221;</p>
<p>Adele is also expected to perform at the BRITs, Britain&#8217;s top music accolades, in London on February 21.</p>
<p>Appearing with her at the 54th Grammy Awards show will be acts including Coldplay, Rihanna, Bruno Mars, Paul McCartney, Nicki Minaj and Taylor Swift.</p>
<p>Adele has been nominated for six Grammys this year &#8212; record of the year, song of the year and best short form music video for Rolling In The Deep, album of the year and best pop vocal album for 21 and best pop solo performance for &#8220;Someone Like You.&#8221;</p>

			<content:encoded><![CDATA[<p>(Reuters) &#8211; If the president and Congress are serious about income equality and cutting huge breaks for the wealthy, they should raise the capital gains rate.</p>
<p>While the president didn&#8217;t mention it by name in his State of the Union speech on January 24, it&#8217;s one of the many gorillas in the tax reform room.</p>
<p>There&#8217;s no question that the 15 percent rate on capital gains and dividends largely favors super-wealthy taxpayers over wage earners. Just look at Mitt Romney&#8217;s tax return. As former Labor Secretary and economist Robert Reich once noted: &#8220;It&#8217;s a loophole large enough for the super-rich to drive their Ferraris through. About 80 percent of the income of America&#8217;s richest 400 comes in the form of capital gains.&#8221; (link.reuters.com/gen36s)</p>
<p>According to economist Jared Bernstein, who analyzed Congressional Research Service figures, capital gains and dividends were &#8220;the largest single contributor to the growth of inequality from 1996-2006.&#8221; (link.reuters.com/hen36s)</p>
<p>Why should those who primarily make money from private equity, financial, business and real estate appreciation and dividends pay more than 50 percent less than wage workers who are subject to the top rate in federal, state, Medicare and Social Security taxes?</p>
<p>If you&#8217;re from the supply-side camp, it&#8217;s because the lower rate may encourage wealthy taxpayers to invest in capital, business and job formation while raising more tax revenues. More fundamentally, at least according to the conservative group Americans for Tax Reform, &#8220;when you tax something more, you get less of it.&#8221;</p>
<p>When taxpayers know that the capital gains rate is going up, the &#8220;fire sale&#8221; effect comes into play: They sell assets to get taxed at the lower rate before the higher levy kicks in, hence the higher cash flow to the Treasury before the lower tax expires.</p>
<p>But there&#8217;s no consistent evidence that shows that a lower capital gains rate does much for the economy long term. The rate of new business formations actually climbed from 1983-1987, when the maximum capital gains rate was 20 percent, according to the Kauffman Foundation, a think tank that specializes in entrepreneurism. <p>When the gains rate hit a maximum 29 percent from the middle of 1993 into 1997, there was another spurt of new business growth. Since 2006, though, small-business creation has generally fallen &#8211; even with the lower capital gains rate. The recession and housing meltdown are the likely malefactors.</p>
<p>Of course, recessions or periods of double-digit interest rates &#8211; which hurt small businesses the hardest &#8211; are the worst times for small-firm growth anyway, so the capital gains rate would not necessarily have been a primary hindrance during times like 1979 through 1983.</p>
<p>When do capital gains proceeds fill up the national Treasury the most? The data is inconclusive. In 1988, realized gains as a percentage of gross domestic product were more than 7 percent &#8211; the highest amount in almost a quarter century, and that was when gains rate was 20 percent.</p>
<p>Tax rates are often like porridge. Sometimes they may be too high; at other times just right. It could be that 20 percent is a sweet spot for gains. In contrast, the lowest capital gains/GDP percentage was 1.57 percent in 1977, when the maximum rate was nearly 40 percent.</p>
<p>What can barely be debated is that the capital gains rate is one of the multi-millionaire&#8217;s best fiscal friends. Those who made $10 million or more, according to IRS statistics from 2009, reaped a total of nearly $70 billion in long-term capital gains. That&#8217;s 10 times the amount of gains taken by those making from $75,000 to $100,000.</p>
<p>While cutting the capital gains rate generates more revenue overall due to the fire-sale effect, it&#8217;s not in the best interest of the country to keep it at 15 percent. Raising it would also reduce the burgeoning federal deficit. If it&#8217;s not an efficient way of creating jobs or businesses, why keep it so low?</p>
<p>&#8220;Arguments that the capital gains rate affects economic growth are even more tenuous,&#8221; says the non-partisan Tax Policy Center. The group saw no correlation between rates and GDP growth &#8220;during the last 50 years.&#8221;</p>
<p>Of course, the gains rate is but one item among thousands of special breaks in the tax code. You have to put everything on the table, from mortgage deductions to offshore corporate income if you want to ferret out wasteful tax handouts, which is highly unlikely in this election year.</p>
<p>Yet if one believed that Congress was earnestly tackling deficit reform in the interest of fairness and fiscal sanity &#8211; or did nothing this year &#8211; I would tell my tax preparer to take every possible break in 2012. That&#8217;s because the special rate on capital gains will expire after December 31 &#8211; a deadline that will seem pretty urgent right around election time in November.</p>

			<content:encoded><![CDATA[<p>(Reuters) &#8211; Facebook&#8217;s initial public offering is likely to set a new standard for how low investment banks are willing to go on advisory fees to win big business.</p>
<p>The world&#8217;s largest online social network is expected to tap public markets for $10 billion in the coming months in an offering that will value the company at up to $100 billion, according to sources familiar with the planned IPO. It will be one of the biggest U.S. market debuts ever, and a prized trophy for the investment bankers seeking to win lead advisory roles.</p>
<p>That has set up a fierce competition on Wall Street, particularly between the presumed front-runners Morgan Stanley and Goldman Sachs Group Inc, which may offer their underwriting services for as little as 1 percent of gross proceeds, bankers and industry observers said.</p>
<p>That would be far less than the 7 percent fee that smaller deals typically fetch, or the 2 or 3 percent that large deals tend to command.</p>
<p>&#8220;The Facebook IPO will be iconic,&#8221; said James Montgomery, chief executive of San Francisco-based investment bank Montgomery &#038; Co, which advises tech companies on mergers, acquisitions and private placements.</p>
<p>Facebook can easily negotiate a 1 percent fee for the entire group of investment banks that will peddle its shares, Montgomery said, &#8220;much to the chagrin of the underwriters.&#8221;</p>
<p>Such a low fee is practically unheard of for investment banking deals, apart from the offerings of bailed-out companies General Motors Co, American International Group Inc and Ally Financial Inc, which sold shares held by the U.S. government in the aftermath of the financial crisis.</p>
<p>But Facebook has several advantages that will allow the company to haggle for a lower fee: it will be an easy sell as hoards of investors are keen to jump on the social media trend, and even a 1 percent fee would reap $100 million in revenue for investment banks, sending a lead advisor to the coveted No. 1 spot on IPO league tables.</p>
<p>&#8220;There&#8217;s no other IPO like this,&#8221; said Lee Simmons, a tech specialist at Dun &#038; Bradstreet. &#8220;It&#8217;s kind of the 800-pound gorilla for the tech sector.&#8221;</p>
<p>The Wall Street Journal reported that Facebook plans to file IPO documents with U.S. securities regulators as early as Wednesday, and is close to picking Morgan Stanley as the lead underwriter.</p>
<p>The typical IPO that raises less than $500 million incurs a 7 percent fee &#8212; what&#8217;s known as &#8220;the 7 percent solution.&#8221; But as IPOs grow in size, the fee percentage shrinks.</p>
<p>Investment banks usually earn fees of 4 percent to 5 percent on IPOs of more than $1 billion, but deals from Silicon Valley tend to carry a premium. U.S. tech IPOs of at least $1 billion carried an average fee of 5.8 percent from 2000 to 2012, on average, according to Thomson Reuters data.</p>
<p>In the case of Facebook &#8212; whose T-shirt-wearing, 27-year-old chief executive, Mark Zuckerberg, is said to appreciate status updates more than stock brokers &#8212; it&#8217;s unlikely advisors will be able to command the standard rate.</p>
<p>&#8220;These Valley types think this whole process could be automated and they don&#8217;t have to pay 7 percent to these flashy, French-cufflink-wearing Wall Street types,&#8221; said Eric Jackson, founder and managing member of Ironfire Capital, a technology-focused hedge fund, who has interacted professionally with executives at Facebook and other social-media companies.</p>
<p>PRICING DILEMMA</p>
<p>Facebook&#8217;s offering will be the largest ever IPO from Silicon Valley, as well as the largest global high-tech IPO since the dot-com bubble burst. The most recent U.S. social-media IPO, Zynga Inc, raised just one-tenth of the proceeds Facebook is hoping for.</p>
<p>Winning a lead advisory role on Facebook has become a make-or-break contest for tech bankers such as Goldman&#8217;s George Lee, Morgan Stanley&#8217;s Michael Grimes and Credit Suisse&#8217;s Bill Brady.</p>
<p>Morgan Stanley and Goldman Sachs have been in communication with Facebook for months and already offered pitches to its executives in hopes of becoming lead adviser, according to sources briefed on the meetings.</p>
<p>Wall Street is now waiting to hear who will win the coveted &#8220;lead left&#8221; title, referring to where the top underwriter&#8217;s name will appear on the IPO prospectus.</p>
<p>&#8220;Facebook is one of the most well-known brands around the globe,&#8221; said George Papaioannou, a business professor at Hofstra University who has studied underwriting competition among investment banks. &#8220;The underwriters will have to do very little convincing to investors, and that gives Facebook a huge negotiating advantage.&#8221;</p>
<p>Investment banking fees are not usually the primary concern for IPO candidates, who must nail down the right offering price and sell shares to the right mix of investors, Papaioannou said.</p>
<p>If the offering price is too high, the company and its underwriters risk burning IPO investors. If the bar is set too low, the stock issuer risks leaving money on the table. And if the mix is not right &#8212; with more short-term traders than long-term investors &#8212; a stock can become highly volatile in the days and weeks following its debut on an exchange.</p>
<p>Zynga, which makes some of the most popular online games that are played on Facebook, is a prime example. Co-managed by Goldman and Morgan Stanley, the IPO was priced at $10 a share in mid-December. IPO investors watched the stock fall 5 percent on the first day of trading. Zynga was quoted at $9.72 on Friday.</p>
<p>Similarly, online coupon-deals site Groupon Inc priced its IPO at $20 a share on November 4, but its shares fell as much as 26 percent in the first two weeks of trading. The stock was trading at $19.78 on Friday. Goldman, Morgan Stanley and Credit Suisse were co-managers of the IPO.</p>
<p>HANDLE WITH CARE</p>
<p>The other edge of the IPO sword can cut just as sharply for hot tech stocks.</p>
<p>LinkedIn Corp, which raised $353 million last May in an IPO priced at $45 a share, watched the stock soar as high as $122.70 on the first day of trading. LinkedIn shares have drifted down to the low $70 range, but the price range to date indicates that the company could have raised another $440 million to $1 billion in extra money if the IPO were priced more aggressively. Morgan Stanley was in the lead left position.</p>
<p>A sharp fluctuation in price soon after Facebook&#8217;s IPO &#8220;would really embarrass Facebook and the underwriters,&#8221; given the recent history of social-media IPOs, said Papaioannou</p>
<p>The Zynga, Groupon and LinkedIn deals garnered fees of 3 to 5 percent.</p>
<p>To be sure, the banks that are vying for a lead position on Facebook&#8217;s IPO will have to do more than lowball on price. They will also have to convince the Palo Alto, California-based company that the deal will go off without a hitch.</p>
<p>As Facebook&#8217;s size and influence have grown in recent years, its actions &#8212; whether changes to privacy policies on its popular networking site, or its interactions with Wall Street bankers &#8212; have come under intense public scrutiny.</p>
<p>Goldman&#8217;s handling of a private sale of $1.5 billion worth of Facebook shares to wealthy clients last year stirred enough controversy that the bank was forced to limit the offering to non-U.S. investors.</p>
<p>That misstep may have cost Goldman some goodwill with Facebook, industry observers said. And, as a company that makes money from a broad base of users, it also forces Facebook to consider whether its IPO will give unfair advantages to well-heeled investors.</p>
<p>&#8220;Two reasons I think Morgan Stanley will get the lead: one, they have a great retail distribution platform with the Smith Barney franchise and, two, I don&#8217;t think Facebook is overly happy with Goldman Sachs,&#8221; said Jeff Sica, president and CEO of SICA Wealth Management, who has bought shares of Facebook in private, pre-IPO markets for clients.</p>
<p>Morgan Stanley was the top bookrunner for global high-tech IPOs last year, with $2.2 billion in global proceeds and 10.9 percent market share. It also led the pack in U.S. high-tech IPOs, according to Thomson Reuters data. Goldman Sachs was the runner up with $1.9 billion in global fees and 9.2 percent market share, and ranked No. 3 in U.S. high-tech IPOs behind JPMorgan Chase &#038; Co.</p>
<p>A less measurable but equally important factor in obtaining the lead IPO position is whether bankers can connect with decision-makers at Facebook on a personal level.</p>
<p>&#8220;It&#8217;s really going to be the banker that understands and is sensitive to Zuckerberg and the executive team&#8217;s needs,&#8221; said Dun &#038; Bradstreet&#8217;s Simmons. &#8220;Whoever does that successfully will get the bragging rights, the proverbial brass ring of tech IPOs.&#8221;</p>

			<content:encoded><![CDATA[<p>(Reuters) &#8211; Former Penn State University football coach Jerry Sandusky, who is under house arrest on charges of child sexual abuse, has asked a Pennsylvania court to allow supervised visits with his grandchildren that are now prohibited.</p>
<p>Sandusky, 67, faces 52 criminal charges that he molested 10 boys over a 15 year period and has been tethered to his house under the terms of his release on bail in December that barred contact with anyone under age 18. He has maintained his innocence.</p>
<p>In a motion filed Friday, Joe Amendola, attorney for the former Penn State defensive coordinator, asked the Centre County Court to modify the terms of Sandusky&#8217;s release to permit supervised contact with his 11 grandchildren.</p>
<p>&#8220;The Defendant&#8217;s minor grandchildren have expressed their sadness to their parents about not being able to visit or talk with the Defendant since November 5, 2011,&#8221; Amendola wrote.</p>
<p>If his grandchildren were allowed to visit him at his State College home, they would be accompanied by at least one parent, according to the motion.</p>
<p>Amendola is also asking the court to allow Sandusky to communicate with his grandchildren by mail, email, telephone, or by Skyping, a type of video-chatting over the Internet.</p>
<p>Sandusky was charged November 5 with 40 counts of molesting eight boys over a 15 year period. He had been freed after posting $100,000 after those charges were filed in November.</p>
<p>In December, he was arrested a second time and prosecutors added charges that raised the number of sex abuse victims to 10. He has been under house arrest since he was freed on $250,000 bail following his second arrest with restrictions.</p>
<p>Prosecutors say Sandusky used his position as head of The Second Mile charity to find his victims. Sandusky started The Second Mile charity to help troubled disadvantaged children.</p>
<p>His grandchildren are not the only people Sandusky would like to be in contact with.</p>
<p>Amendola said Sandusky wants &#8220;reasonable visitation&#8221; by friends at his home and he wants the ability to leave his home &#8220;for the purposes of assisting his attorneys, private investigators, and other professional individuals retained by the Defendant in the preparation of his defense.&#8221;</p>
<p>The charges against Sandusky caused an avalanche of top-down changes at Penn State. Soon after his arrest, the school&#8217;s board of trustees fired iconic head football coach Joe Paterno, who died of lung cancer on Sunday, and university president Graham Spanier.</p>
<p>Also on Friday, Amendola followed up a request for prosecutors to turn over the names of the people who accused Sandusky and the details of those crimes. The attorney said a week had passed since his original request.</p>
<p>Centre County Court Judge John Cleland is scheduled to consider both matters on February 10. Prosecutors have until February 3 to file responses to the requests.</p>

<p>The movie about a fading star whose career is eclipsed by the woman he loves just as talkies are putting an end to silent pictures has been a critical darling throughout the Hollywood&#8217;s current awards season.</p>
<p>&#8220;This is really touching and moving for me,&#8221; said French director Hazanavicius upon accepting his award at the Grand Ballroom adjacent to the Kodak Theatre where the Oscars, the film industry&#8217;s highest honors, will be given out on February 26.</p>
<p>&#8220;It&#8217;s maybe the highest recognition I could hope for,&#8221; he said.</p>
<p>The DGA Awards are a key indicator of who may win Academy Awards next month because only six times since the DGA began handing out annual honors in 1948 has the its winner failed to also be named best director by Oscar voters.</p>
<p>More important, there is a long history among members of the Academy of Motion Picture Arts and Sciences, which gives out the Oscars, to give their Academy Award for best film to the movie made by the winner of best director.</p>
<p>The next stop in the race for Oscars is Sunday&#8217;s Screen Actors Guild awards in Los Angeles where &#8220;The Artist&#8221; will look to extend its streak of victories, including a Golden Globe for best film musical or comedy and honors from critics groups.</p>
<p>The DGA also gives out other awards, including one for best film documentary, which went to James Marsh for &#8220;Project Nim.&#8221;</p>
<p>Among TV award winners, Patty Jenkins was given the DGA trophy for best drama series for the pilot episode of &#8220;The Killing&#8221; and Robert B. Weide took home the DGA award for best comedy series for an episode of &#8220;Curb Your Enthusiasm.&#8221;</p>

			<content:encoded><![CDATA[<p>(Reuters) &#8211; Receiving an honor from Britain&#8217;s Queen Elizabeth marks the pinnacle of many careers. But for more than 250 people named in a once-secret official document, the idea was so unappealing that they turned down the monarch&#8217;s offer.</p>
<p>Artist Lucian Freud, sculptor Henry Moore and &#8220;Charlie and the Chocolate Factory&#8221; author Roald Dahl all rejected honors, according to papers released by the British government on Thursday.</p>
<p>&#8220;Psycho&#8221; film director Alfred Hitchcock also refused an award in 1962, only to accept a knighthood shortly before his death in 1980.</p>
<p>Other public figures named on the official list include painters Francis Bacon and L.S. Lowry and the &#8220;Brave New World&#8221; novelist Aldous Huxley.</p>
<p>The British government was forced to publish the document after repeated requests under freedom of information laws.</p>
<p>Previously, rejected honors only came to light through unofficial leaks or if the person involved chose to spoke about their decision to snub the twice-yearly &#8220;gongs.&#8221;</p>
<p>Several well-known writers appeared on the list, which only includes people who are no longer alive.</p>
<p>Poet Philip Larkin refused the chance in 1968 to become an OBE, or Officer of the Order of the British Empire, one of the five classes of the chivalric order set up by King George V in 1917 to recognize service in the arts, science, charities and public bodies. Larkin later accepted a higher ranking CBE, or Commander of the Order of the British Empire.</p>
<p>Eveyln Waugh, who wrote &#8220;Brideshead Revisited&#8221; and &#8220;Scoop,&#8221; rejected an offer in 1959 to become a CBE.</p>
<p>Graham Greene, author of &#8220;Our Man in Havana&#8221; and &#8220;The Quiet American,&#8221; turned down the same honor three years earlier, only to accept honors later in life. &#8220;The Chronicles of Narnia&#8221; creator C.S. Lewis also said no to a CBE.</p>
<p>The government gave no details of why people rejected their honors.</p>
<p>In the past, &#8220;refuseniks&#8221; have cited a range of reasons, from antipathy to the monarchy and Britain&#8217;s colonial past, to a general lack of interest in prizes or a fear of perpetuating snobbery.</p>
<p>The late J.G. Ballard, whose books include &#8220;Crash&#8221; and &#8220;Empire of the Sun,&#8221; said he turned down an honor for services to literature in 2003.</p>
<p>&#8220;The whole thing is a preposterous charade,&#8221; he was once quoted as saying in the Sunday Times newspaper. &#8220;Thousands of medals are given out in the name of a non-existent empire. It makes us look like a laughing stock.&#8221;</p>

			<content:encoded><![CDATA[<p>(Reuters) &#8211; The fun and games of the National Hockey League&#8217;s All-Star weekend turned serious Saturday as league commissioner Gary Bettman and player&#8217;s union chief Donald Fehr danced around questions about a looming labor war.</p>
<p>With the current collective bargaining agreement (CBA) set to expire on September 15, NHL owners and the players association (NHLPA) have been quietly preparing the framework for negotiations that could prove as contentious as those that wiped out the entire 2004-05 season.</p>
<p>Following a board of governors meeting Saturday, Bettman said, there was no set date for negotiations to commence but talks are expected to begin in the days following Sunday&#8217;s All Star game.</p>
<p>&#8220;My hope is that we can reason together and that collective bargaining will be painless and quiet and quick,&#8221; Bettman told reporters following the board meeting. &#8220;That would serve everyone&#8217;s best interest.&#8221;</p>
<p>Early indications are that negotiations will be neither quick nor painless.</p>
<p>Fehr, who has earned a reputation as a tough and fearless negotiator from his years heading up Major League Baseball&#8217;s players union, fired a warning shot across the NHL&#8217;s bow earlier this month when he rejected the league&#8217;s plan for realignment and a modified playoff format.</p>
<p>NHL owners also appear emboldened by the significant gains made by National Football League (NFL) and National Basketball Association (NBA) owners in their labor battles last year.</p>
<p>Under the current CBA, NHL players receive 57 percent of hockey related revenue and owners would like to see that number come down closer to a 50-50 split like the NBA and NFL.</p>
<p>Fehr is no fan of the salary cap system, which he refused to accept as head of the baseball players union and is widely expected to push for a CBA that looks more like MLB&#8217;s, which remains the only major North American league without a hard cap.</p>
<p>&#8220;There&#8217;s significant information that we don&#8217;t have,&#8221; said Fehr adding, &#8220;We will be prepared to negotiate an agreement.&#8221;</p>
<p>The only numbers hockey fans were interested in on Saturday, however, were those put up by players taking part in the hardest shot competition won by Boston Bruins captain Zdeno Chara with a record-smashing 108.8 mph blast.</p>
<p>While the NHL has not found anything to match the excitement of MLB&#8217;s home run derby or the NBA&#8217;s slam dunk competition, the hardest shot contest is the event most came to see.</p>
<p>Chara, who set the record of 105.9 mph at last year&#8217;s skills competition, bettered that mark on his first attempt, slamming a 106.2 mph slap shot.</p>
<p>The hulking defenseman then made sure he would keep his title with a 108.8 mph rocket that drew gasps from the capacity crowd.</p>
